Most workplace investigations are completed within 2-6 weeks, depending on complexity. Simple cases with few witnesses may conclude in 1-2 weeks, while complex matters involving multiple complainants or extensive documentation may take 6-8 weeks. 


Workplace investigations can be conducted by internal HR personnel, employment attorneys, or independent third-party investigators. Independent investigators provide the highest level of neutrality and credibility, particularly in sensitive cases involving senior leadership or legal risk.
 


Workplace investigations typically use the "preponderance of the evidence" standard, meaning it is more likely than not (greater than 50% probability) that the alleged conduct occurred. 


Investigations are kept confidential to the extent possible while still allowing for thorough fact-finding. Information is shared only on a need-to-know basis. However, absolute confidentiality cannot be guaranteed because due process requires disclosure to the accused party. 


Investigation reports can potentially be used as evidence in litigation, though they may be subject to attorney-client privilege or work product protection if properly structured through legal counsel.
